TITLE II. THE GOVERNMENT AND REPRESENTATION OF THE UNIVERSITY. CHAPTER I

General disposals

Article 39. Nature of the organs of government

1. The government, the representation and the administration of the University articulate through the following organs:

To) Collegiate:

- The Social Council,
- The Claustro University,
- The Council of Government,
- The Council of Direction,
- The claustros and the boards of faculty and of school,
- The councils of department, of university institute of investigation and of other centres or structures that, in his case, constitute according to the present Statute.

b) Unipersonales:

- The rector or rector,
- The vice-chancellors or vice-chancellors,
- The secretary or general secretary,
- The assistant secretary or general assistant secretary, in his case,
- The or the manager,
- The and the vicegerentes, in his case,
- The deans or deans and the vicedecanas or vicedecanos of faculty,
- The directors or directors and the deputy directors or deputy directors of school,
- The directors or directors of secretariat, in his case,
- The directors or directors of department, university institute of investigation and of the centres and structures that can constitute,
- The secretaries or secretaries of faculty, school, department and university institute of investigation,
- The deputy directors or deputy directors of department and university institute of investigation, in his case.

2. They are general organs of the University:

- The Social Council,
- The Claustro University,
- The Council of Government,
- The Council of Direction,
- The rector or rector,
- The vice-chancellors or vice-chancellors,
- The secretary or general secretary,
- The or the manager,
- The assistant secretary or general assistant secretary, in his case,
- The and the vicegerentes, in his case,
- The directors or directors of secretariat, in his case.

3. Except forecast in contrary in the valid legislation or in this Statute, the decisions that in the exercise of his competitions adopt the general organs will prevail on the ones of the other organs, and the ones of the collegiate bodies on the ones of the unipersonales.

Article 40. Representation in the collegiate bodies and exert of charges unipersonales

The election of representatives of the distinct sectors of the university community in the Claustro University, in the claustros of faculty and school, in the councils of department and university institute of investigation, as well as in the centres to that refers the article 30, will realise by means of universal suffrage, free, the same, direct and secret, according to the electoral norms that establish in this Statute.
For the exert of the charges unipersonales will be indispensable requirement the dedication to complete time in this University, without that in no case they can exert simultaneously two or more charges of said nature.
The University will promote the participation of the women in all the levels of representation and direction, with the aim to achieve the representation balanced between women and men in all the organs of government, consultative and of representation, for what will establish the necessary norms in the electoral procedures.

Article 41. Constituents and eligible and electoral procedure

The distinct planned elections in this Statute will carry out necessarily inside the period lectivo.
Except contrary forecast of the present Statute, will have the condition of constituents and eligible in the distinct elections the and the members of the university community that, in his respective field, find in active and effective service, are ascribed or enrolled by the modality of matrícula ordinary.
The right of active and passive suffrage alone will be able to exert in one of the bodies and circunscripciones electoral that in the respective fields establishes .
The right of passive suffrage requires, necessarily, that the constituent or present constituent in term his candidature, that will have anyway individual character, and was proclaimed definitively by the respective electoral board.
To the exclusive effects to participate in the distinct elections, the personnel of the University that have a temporary relation or of interinidad will be equated to the corresponding body or community, in accordance with the conditions that in each case foresee in accordance with the regulations.
To the planned effects in the previous section, the alumnado will have to be enrolled by the modality of matrícula ordinary in the academic course in that they summon elections. This disposal is of application to the alumnado that curse official studies.
The vote is personal and indelegable in all the elections, and will not admit in no case the vote by post. In accordance with the regulations it will establish the procedure for the exercise of the vote of form anticipated.
In the elections to the collegiate bodies, only will be able to award the vote to a number of candidates or equal or inferior candidates to the seventy percent of representatives that correspond to choose in his community and circunscripción, save in those suppositions in which only it have to choose one or a representative.

Article 42. Competitions of the electoral boards

The Electoral Board of the University and the electoral boards of faculty and school, each one in his respective field, will have the following basic functions:
To) Publish the electoral census, and determine in his case how many representatives corresponds to choose in each community or circunscripción, and approve the definite electoral census.
b) Proclaim the candidatures.
c) Look after the process of election of those who integrate the electoral tables and his constitution.
d) Approve the models of records and necessary documents for the group of the electoral process.
And) Authorise the electoral advertising.
f) Proclaim the candidates or elect candidates and issue the credenciales supporting.
G) Resolve the claims that direct him with occasion of the development of the electoral process.
h) Interpret and apply the electoral rule and any another that derive of the same that it was pertinent for the suitable development of the electoral procedures.
In addition to the competitions collected in the previous section, the Electoral Board of the University will resolve the resources posed against the resolutions of the electoral boards of centre.
The electoral boards will have of the precise material means for the normal fulfillment of his functions.
The electoral boards will be aided by personal technician of the Juridical Service and by technical personnel of the linguistic services.

Article 43. Composition of the Electoral Board of the University

The Electoral Board of the University will be composed by:
To) Three members to complete time of the profesorado with permanent links to the University.
b) Three students.
c) Three members to complete time of the personnel of administration and services.
It will act of president the professor or professor of greater category between the designated and, inside them, the one who possess greater antiquity in the degree, and of secretary or secretary will act the or the member that the Board designate.
The designation of components, headlines and acting, of the Electoral Board of the University will realise by means of public draw by the Council of Government for a period of four years. His renewal will take place, anyway, prior to the opening of the process of ordinary election again Claustro University.

Article 44. Composition of the electoral boards of faculties and schools

The electoral boards of faculty and school will be composed by:
To) Two members to complete time of the profesorado with permanent links to the University.
b) Two students.
c) Two members to complete time of the personnel of administration and services.
The designation of components, headlines and acting, of the electoral boards of faculties or schools will realise by means of public draw summoned to the effect by the dean or director or the dean or director of the centre, and renewed each four years. His renewal will take place, anyway, prior to the opening of the process of ordinary election again claustro of centre.
It will be of application to these electoral boards the had in the section 2 of the previous article.

Article 45. Resolution of other electoral processes

The claims that can formulate in distinct electoral processes to which are competition of the Electoral Board of the University or of the electoral boards of faculty and school will be resolved by the rector or rector.

Article 46. Electoral tables

The electoral tables, save in the circunscripciones formed by an alone community, will be composed by three members of the university community designated by draw of between those who no concurran like candidates or candidates to the corresponding elections and are not members of the respective electoral boards.
The draw of the three members, headlines and acting, will effect taking into account the following communities:

Article 47. Situations of the charges unipersonales elect

In case of absence, illness or cessation by concurrence to reelection for the same charge of those who are headlines of the charges unipersonales elective, will assume interinamente his functions the organ that correspond according to the forecasts of this Statute. This situation will not be able to prolong more than six months.
In the other suppositions of cessation of those who are headlines of the charges unipersonales elective, will remain interinamente in his functions until the nomination of his substitutes or substitutes and, in extraordinary cases, will be to the had in the previous section.

Article 48. Cessation of the and the members of the collegiate bodies and other charges unipersonales designated

In principle, and except the willing specific forecasts in this Statute, will cease those who integrate the collegiate bodies and the headlines of the charges unipersonales designated on request own, when it conclude the period of mandate, by decision of the one who designated them or when it conclude the mandate of east.
