TITLE II. THE GOVERNMENT AND REPRESENTATION OF THE UNIVERSITY. CHAPTER IV

Of the organs of the departments

Section 1ª. Of the councils of department

Article 88. Composition

1. The council of department, organ of government of the same, will be formed by:

a) born Members:
It will be it all the educational personnel and researcher doctor and the educational personnel and researcher with permanent links to the department, that will constitute the 75 % of the council.

b) Integral representatives of the distinct communities, that will constitute the 25 % remaining, in accordance with the following distribution:

- 10 % that will choose by and between the educational personnel and researcher without permanent links and the personal researcher in training,
- 10 % that will choose by and between students enrolled in the asignaturas of official studies that give the department,
- 5 % that will choose by and between the personnel of administration and destined services in the department.

Anyway, it will guarantee at least one or a representative by each community.

2. The elective part of the council of department will renew each two years by means of elections summoned to the effect by the director or director. The department, in collaboration with the centres and the delegations of students, will promote the participation of the alumnado in the process electoral.

3. The elections to the council will carry out according to the had in this Statute and in the internal regulations of each department, which will develop and will complete the no planned appearances.

4. In these electoral processes will be of application analogous forecasts to the willing around the elections to the claustro of faculty or school, as well as the had in case of vacancies.

Article 89. Competitions

They correspond to the council of department the following competitions:

a) Elaborate and approve the proposal of regulation of internal diet, as well as his modification.
b) Choose and stir up, in his case, to the director or director of the same.
c) Elaborate relative reports to the creation, modification, denomination, ascription and supresión of departments.
d) Approve the proposal of modification of the staff of educational personnel and researcher and of personnel of administration and services.
e) Choose and stir up, in his case, to representatives of the department in the distinct commissions of the centre or of the University.
f) Propose the announcement of the vacant squares of the university educational bodies and elevate the proposal of the and the members of the commissions according to the foreseen in this Statute.
g) Participate in the procedures of evaluation of the educational personnel and researcher.
h) Participate in the procedures of evaluation, certification and accreditation of the University that affect to his activities.
i) Approve the proposal of budget and the settlement of accounts of the same.
j) Establish the needs of personnel and material that are precise for the development of the activities of the department.
k) Approve the plan of educational performance and researcher and the annual memory of the department, before the start of each academic course.
l) Issue, in his case, report of ascription of his members to university institutes of investigation.
m) Distribute the educational activity between his members and supervise the quality of the teaching that gives .
n) Propose and develop own educations of postgraduate and specialisation and, in his case, educations of doctorate in matters of his fields of knowledge or in collaboration with other departments, university institutes of investigation or other centres.
o) Know, coordinate and spread the activities researchers of those who integrate the department.
p) Inform preceptively and propose the designation of members of the commissions evaluadoras for the obtaining of the degree of doctor.
q) Any another that attribute him the valid legislation and the present Statute.

Article 90. Organisation and operation

The council of department will gather :
a) In ordinary session, at least twice to the semester.
b) In extraordinary session, whenever it was summoned by the director or director, to own initiative or when they request it at least a fifth part of his members.
The internal regulation of the department will be able to foresee the creation of a standing committee of the council that act by his delegation for the exert of his functions, determining the functions delegated and the composition of the same.
Anyway, the standing committee of the council will be formed, at least, by a person in representation of each one of the communities.

Section 2ª. Of the director or director

Article 91. Functions and election

The director or director of department has the representation of east and exerts the functions of direction and ordinary management of the same.
The council of department will choose director or director between his profesorado doctor with permanent links to the University that loan services to complete time.
It will result chosen director or director the one who obtain the greater number of votes in the session of the council of department that had summoned with an antelación minimum of a month to the date of expiración of the ordinary mandate and with this exclusive object. It will not admit in these processes the delegation of vote.
The nomination of director or director, in accordance with the proposal of the council of department, corresponds to the rector or rector. His mandate will determine in the internal regulation, will not be able to exceed of four years and will be possible his reelection an alone time of consecutive form.
Of not being able to effect the nomination of the director or director of the department by fault of candidates that gather the requirements demanded, the rector or rector, once heard the council of department, will commission provisionally the functions of direction to a member of the profesorado of the department, that will summon elections to director or director in the time limit of six months.
The director or director of department will be able to be stirred up by the council of department. The motion of censorship will have to be presented by, at least, a fifth part of those who integrate the council, and will require for his approval the favourable vote of the absolute majority of members that compose it.
They will be of application, likewise, in these cases the complementary forecasts contained in the article 83 of this Statute.
The regulation of internal diet of the department will regulate the announcement of elections, the procedure and other exigencias to complete the established in the present article.

Article 92. Competitions

They correspond to the director or director of department the following competitions:

a) Represent to the department, direct it and coordinate his ordinary management.
b) Summon and chair the meetings of the council of department.
c) Execute the agreements adopted by the council of department.
d) Supervise the execution of the plans of activities to develop by the department and elaborate the annual memory of the same.
e) Look after the fulfillment of the dedication of the educational personnel and researcher.
f) Direct the activity of the personnel of administration and services ascribed to the department.
g) Any another function that attribute him the valid legislation and the present Statute, as well as those that can be him delegated by the council of department.

Section 3ª. Of the deputy director or deputy director and the secretary or secretary

Article 93. Nomination, cessation and functions

The rector or rector will appoint, in his case, to the deputy directors or deputy directors of department, to proposal of the director or director of the department, of between the profesorado doctor with permanent links to the University ascribed to the department that loan services to complete time.
The deputy director or deputy director collaborates with the director or director in the government and direction of the department, exerting those that functions assign him or delegate, and substitutes him in case of vacancy, absence or illness.
The rector or rector will appoint secretary or secretary, to proposal of the director or director of the department, between the profesorado to complete time ascribed to the same.
To the secretary or secretary corresponds the preparation and custody of the records and official documents of the department, the collaboration in the coordination of the management of the same, give faith of the agreements of the council, and those that functions can be him entrusted by the director or director.
The deputy directors or deputy directors and the secretaries or secretaries of the departments will cease in his on request own charges, to proposal of the director or director, or when it conclude his mandate. In this last supposition, will continue in his charges interinamente in so much do not produce the nomination of new director or new director.
